The ICC’s Records of the Proceeding
The Prosecutor of the International Criminal Court on 20 May 2024 announced that he was requesting the issuance of arrest warrants from the Court for Hamas leaders, Yahya Sinwar, Mohammed Diab Ibrahim Al-Masri (Deif), Ismail Haniyeh, and Israel’s Prime Minister Benjamin Netanyahu and Minister of Defense Yoav Gallant. Following the request, the Court permitted the submission of written observations by interested third parties. Over 70 submissions were filed with the Court. While the Prosecutor’s application was pending before the Pre-Trial Chamber of the Court, Sinwar and Haniyeh were killed, the Court acknowledging the death of Haniyeh. On 21 Nov 2024, the Court announced that it had issued arrest warrants against Netanyahu and Gallant. Israel appeal that decision and the appeals chamber remanded to the pre-trial chamber for reconsideration of the issue of jurisdiction.
