The Constitutions of the 21 countries in the list below all have provisions concerning the ethnic and/or religious basis of their society — comparable to Israel’s Nation State Law. Argentina (1994)
Article 2 – The Federal Government supports the Roman Catholic Apostolic Faith.
Armenia (2015)
Article 18: The Armenian Apostolic Holy Church
1. The Republic of Armenia shall recognize the exceptional mission of the Armenian Apostolic Holy Church, as the national church, in the spiritual life
of the Armenian people, in the development of its national culture, and in the preservation of its national identity.
2. The relationship between the Republic of Armenia and the Armenian Apostolic Holy Church may be regulated by a law.
Cambodia (2008)
Article 43 – Khmer citizens of either sex shall have the rights to freedom of belief. Freedom of belief and religious worship shall be guaranteed by the State on the condition that such freedom does not affect other beliefs and religions or violate public order and security. Buddhism shall be the religion of the State.
Costa Rica (2015)
Article 75 – The Roman, Catholic, Apostolic Religion is that of the State, which contributes to its maintenance, without preventing the free exercise in the Republic of other beliefs that do not oppose themselves to the universal morality or good customs.
Egypt (2014)
Article 1: Nature of the Republic. Egypt is part of the Arab nation and enhances its integration and unity. It is part of the Muslim world, belongs to the African continent, is proud of its Asian dimension, and contributes to building human civilization.
Article 2: Islam, Principles of Islamic Sharia. Islam is the religion of the state and Arabic is its official language. The principles of Islamic Sharia are the principle source of legislation.
Greece (2008)
Article 3 –
1. The prevailing religion in Greece is that of the Eastern Orthodox Church of Christ. The Orthodox Church of Greece, acknowledging our Lord Jesus Christ as its head, is inseparably united in doctrine with the Great Church of Christ in Constantinople and with every other Church of Christ of the same doctrine, observing unwaveringly, as they do, the holy apostolic and synodal canons and sacred traditions. It is autocephalous and is administered by the Holy Synod of serving Bishops and the Permanent Holy Synod originating thereof and assembled as specified by the Statutory Charter of the Church in compliance with the provisions of the Patriarchal Tome of June 29, 1850 and the Synodal Act of September 4, 1928.
2. The ecclesiastical regime existing in certain districts of the State shall not be deemed contrary to the provisions of the preceding paragraph.
3. The text of the Holy Scripture shall be maintained unaltered. Official translation of the text into any other form of language, without prior sanction by the Autocephalous Church of Greece and the Great Church of Christ in Constantinople, is prohibited.
Hungary (2016)
Preamble –
- We are proud that our king Saint Stephen built the Hungarian State on solid ground and made our country a part of Christian Europe one thousand years ago.
- We recognise the role of Christianity in preserving nationhood. We value the various religious traditions of our country.
Article VII – 3. The State and religious communities shall operate separately. Religious communities shall be autonomous.
Iran (1989) [Detailed Analysis, by Richard Horowitz (2010)]
Article 1 – The form of government of Iran is that of an Islamic Republic, endorsed by the peopleof Iran on the basis of their longstanding belief in the sovereignty of truth and Qur’anic justice, in the referendum of Farwardîn 9 and 10 in the year 1358 of the solar Islamic calendar, corresponding to Jamadial-‘Awwal 1 and 2 in the year 1399 of the lunar Islamic calendar [March 29 and 30, 1979], through the affirmative vote of a majority of 98.2% of eligible voters, held after the victorious Islamic Revolution led by the eminent marji’ altaqlid, Ayatullah al-‘Uzma Imam Khumayni.
Jordan (2016)
Article 1 – The Hashemite Kingdom of Jordan is an independent sovereign Arab State. It is indivisible and no part of it may be ceded. The Jordanian people is a part of the Arab Nation, and its ruling regime is parliamentary with a hereditary monarchy.
Article 2 – Islam is the religion of the State and Arabic is its official language.
Malaysia (2007)
3. Religion of the Federation
1. Islam is the religion of the Federation; but other religions may be practised in peace and harmony in any part of the Federation.
2. In every State other than States not having a Ruler the position of the Ruler as the Head of the religion of Islam in his State in the manner and to the extent acknowledged and declared by the Constitution of that State, and, subject to that Constitution, all rights, privileges, prerogatives and powers enjoyed by him as Head of that religion, are unaffected and unimpaired; but in any acts, observances of ceremonies with respect to which the Conference of Rulers has agreed that they should extend to the Federation as a whole each of the other Rulers shall in his capacity of Head of the religion of Islam authorise the Yang di-Pertuan Agong to represent him.
3. The Constitution of the States of Malacca, Penang, Sabah and Sarawak shall each make provision for conferring on the Yang di-Pertuan Agong the position of Head of the religion of Islam in that State.
4. Nothing in this Article derogates from any other provision of this Constitution.
Morocco (2011)
Article 1 – Morocco is a constitutional, democratic, parliamentary and social Monarchy… The Nation relies for its collective life on the federative constants [constantes federatrices], on the occurrence of moderate Muslim religion, [on] the national unity of its multiple components [affluents], [on] the constitutional monarchy and [on] democratic choice.
Article 3 – Islam is the religion of the State, which guarantees to all the free exercise of beliefs [cultes].
Norway (2016)
Article 2 – Our values will remain our Christian and humanistic heritage. This Constitution shall ensure democracy, a state based on the rule of law and human rights.
Article 4 – The King shall at all times profess the Evangelical-Lutheran religion.
Article 16 – All inhabitants of the Realm shall have the right to free exercise of their religion. The Norwegian church, an Evangelical-Lutheran church, shall remain the Norwegian National Church and will as such be supported by the State. Detailed provisions as to its system shall be laid down by law. All religious and philosophical communities were to be supported on an equal footing.
Oman (2011)
Article 1 – The Sultanate of Oman is an Arab, Islamic, Independent State with full sovereignty and Muscat is its Capital.
Article 2 – The religion of the State is Islam and Islamic Sharia is the basis for legislation.
Article 3 – The official language of the State is the Arabic language.
Pakistan (2017)
1. The Republic and its territories – 1. Pakistan shall be Federal Republic to be known as the Islamic Republic of Pakistan, hereinafter referred to as Pakistan.
2. Islam to be State religion – Islam shall be the State religion of Pakistan.
Palestinian Authority (2005)
Article 1 – Palestine is part of the larger Arab world, and the Palestinian people are part of the Arab nation. Arab unity is an objective that the Palestinian people shall work to achieve.
Article 4 –
1. Islam is the official religion in Palestine. Respect for the sanctity of all other divine religions shall be maintained.
2. The principles of Islamic Shari’a shall be a principal source of legislation.
3. Arabic shall be the official language.
Qatar (2003)
Article 1. Qatar is an Arab State, sovereign and independent. Its religion is Islam, and the Islamic Law is the main source of its legislations. Its system is democratic, and its official language is the Arabic language. The people of Qatar are part of the Arab Nation.
Somalia (2012)
Article 2: State and Religion –
1. Islam is the religion of the State.
2. No religion other than Islam can be propagated in the country.
3. No law which is not compliant with the general principles of Shari’ah can be enacted.
Sri Lanka (2015)
CHAPTER II: BUDDHISM – 9. The Republic of Sri Lanka shall give to Buddhism the foremost place and accordingly it shall be the duty of the State to protect and foster the Buddha Sasana, while assuring to all religions the rights granted by Articles 10 and 14(1)(e).
Thailand (2017)
Section 67: The State should support and protect Buddhism and other religions. In supporting and protecting Buddhism, which is the religion observed by the majority of Thai people for a long period of time, the State should promote and support education and dissemination of dharmic principles of Theravada Buddhism for the development of mind and wisdom development, and shall have measures and mechanisms to prevent Buddhism from being undermined in any form. The State should also encourage Buddhists to participate in implementing such measures or
mechanisms.
Tunisia (2014)
Article 1 – Tunisia is a free, independent, sovereign state; its religion is Islam, its language Arabic, and its system is republican. This article might not be amended.
United Arab Emirates (2009)
Article 6 – The UAE is a part of the greater Arab nation to which the UAE is linked by the ties of religion, language, history and common destiny. The people of the UAE are one people, and a part of the Arab nation.
Article 7 – Islam is the official religion of the UAE. The Islamic Shari’a is a main source of legislation in the UAE. The official language of the UAE is Arabic.
